Street Tree Service Request

Anyone wishing to have service performed on their street tree should submit a Tree Maintenance Citizen Service Request Form. For additional information please call the Street Tree Management Division at 215-685-4363.

Regulations for the goverment of Parks under the control of the Commissioners of Fairmount Park - Section 401

SECTION 401. Street Trees, Plants and Flowers

  1. Custody and Control. The Commission has exclusive custody and control of, and responsibility for and power to plant, set out, remove, maintain, protect and care for street trees on the streets of the City. See ยง 15-203 of the Philadelphia Code.

  2. Prohibited Conduct.

    • (a) No person shall prune, spray, plant, cut down, break or remove any tree, plant, shrub, flower, flower bed or turf within the Park, or climb or otherwise injure or deface or disturb any tree, tree guard, or support thereof without the approval of the Commission and, where required, under supervision of an authorized agent of the Commission.

    • (b) No guy rope, cable, wire, sign, or other fixture shall be attached or fastened or affixed on any Park tree, street tree or tree support of any Park or street tree, unless authorized by the Commission.

    • (c) No pavement shall be laid within an area of three (3) feet by four (4) feet around the base of the trunk of any Park tree or street tree, nor shall any stone, gravel, cement, lumber, or other material be deposited upon such area.

    • (d) No person shall fasten a horse or other animal to any Park tree, street tree, tree guard of any Park or street tree, or support thereof, or leave any animal fastened to any Park tree, street tree, tree guard of any Park or street tree, or support thereof.

    • (e) No person shall fasten, nail, tack, or maintain any sign on any Park tree, street tree, tree guard of any Park or street tree or support thereof, except as otherwise permitted by the Philadelphia Code.

    • (f) No person shall fasten or lock a motorcycle, bicycle or any other vehicle or equipment to any Park tree, street tree, tree guard of any Park or street tree, or support thereof, except as expressly permitted by the Commission.

  3. Street Tree Maintenance, Trimming and Removal; Dangerous Conditions.

    • (a) The Commission shall, itself or by contract, provide maintenance for all street trees whether abutting private or public property, including but not limited to pruning, spraying (as necessary), and removal of street trees.

    • (b) The Commission shall perform maintenance on street trees in the City on a repeating cycle as scheduled by the Fairmount Park Division of Operations and Landscape Management, subject, however, to available appropriations and to priority of importance, emergencies and unforeseen circumstances.

    • (c) Upon receipt of written notice of a dangerous condition caused by a dead, dying, dangerous, or diseased street tree that clearly identifies the street tree causing the dangerous condition, the Commission shall have the tree inspected by a Park representative or contractor and shall take action as the Commission deems necessary or appropriate, in such time as the Commission deems reasonable, to eliminate the dangerous condition. Written notices of dangerous conditions caused by street trees must be mailed to: Fairmount Park Commission, P.O. Box 21601, Philadelphia, PA 19131, Attention: Director of Operations and Landscape Management; or they may be sent via facsimile to: (215) 685-0065.**

    • (d) A private property owner may, at the owner's own sole expense, plant, maintain and prune, or remove, a street tree and may take necessary or appropriate action to eliminate a dangerous condition caused by a street tree; provided, however, that the private property owner shall, itself or through a qualified contractor hired by the owner, obtain a permit from the Commission for the proposed work, assume all responsibility for the proposed work, and release and indemnify the Commission and City of Philadelphia from and against all liability arising in connection with the work. Contractors hired by private property owners to perform maintenance or other work on a street tree must comply with the requirements of section 401(4) below. The Commission shall not be responsible for any street tree that is planted, maintained, pruned, or removed unless such planting, maintenance, pruning or removal is performed by or with the consent of the Commission in accordance with these regulations.

    • (e) The Commission may perform or authorize the trimming or removal of any tree branches which hang less than 10 feet above the sidewalk, 12 feet above any street, or 16 feet over a principal traffic thoroughfare, or which, irrespective of height, interfere with or obstruct the illumination or visibility of any public street light, traffic sign or traffic control devise.

  4. Private Contractors. Any person engaged in the business of planting, removing, spraying, pruning, bark tracing, and root pruning of street trees in the City of Philadelphia, or who works in, on or around street trees or the roots of street trees in connection with any other work in the City, shall, each time such person is engaged to perform such work, comply with the following rules and regulations relating to the proper performance of said work:

    • (a) He shall obtain a permit from the Commission before performing any work on any street tree or roots of street trees in the City.

    • (b) He shall sign an agreement whereby he will release and agree to hold the City of Philadelphia and the Commission harmless from any and all claims of whatever nature arising from damage of property or injury to any persons, however caused, through the exercise of said permit either by himself, his agent, servant, or employee.

    • (c) He shall obtain comprehensive liability insurance for injury to any person or persons and for damage to any property, in such amount as the Commission may require.

    • (d) A certificate of insurance evidencing such coverage shall be placed on file with the Commission and the Risk Manager for the City of Philadelphia.

    • (e) He shall perform the work described above in good workmanlike fashion and, in addition, shall comply with the published regulations for the care of street trees issued by the Commission.
